Newly Sworn-in Vice President of India from Legal Clan Tight-Lipped over Controversial SC Order

The 14th Vice President of India and Senior Advocate of a Constitutional Court is concerned about tarnishing dignity of judges on social media however fail to comment and justify a recent flawed Supreme Court (SC) order pertaining to a bench of lesser quorum superseding the correctness of the view taken by a bench of larger quorum


The outgoing Chief Justice of India (CJI) NV Ramana in a grand event organized by the Supreme Court Bar Association in New Delhi this Monday felicitated the new Vice President (VP) of India Jagdeep Dhankar.


The CJI said “Simplicity and hard work are newly sworn in VPs strengths, glad someone from legal fraternity reached this position.”


Statement made by the Newly Sworn in Vice President of India


The VP while addressing the audience at the event condemned people who use social media to tarnish the dignity of judges. He said “Dignity of judges is key and among the fundamental parts of the rule of law and Constitutionalism. Recent unfortunate, pernicious trend of targeting individual judges in public domain calls for exemplary containment. Members of the Bar and the Media have a role to play in this.

Independent judiciary is the best way to ensure blossoming of democratic values in the country”, added the VP.


The VP now also share an additional responsibility of the Chairman of Rajya Sabha.


His profile describe him as a Senior Advocate designated by the High Court of Judicature for Rajasthan and former President of Rajasthan High Court Bar Association.


The Controversy


Two-judge bench of India’s top court in the matter of Manubhai Hargovandas Patel Vs. Metropolitan Magistrate Ankush Pundlikrao Khanorkar has been alleged to have ruled a flawed order in gross violation of the order passed by the same court by overruling the correctness of the view taken by a Three-judge bench of larger quorum.


The drama surfaced in a sensitive matter of contempt of court filed by one Manubhai Hargovandas Patel against the trial court Metropolitan Magistrate Ankush Pundlikrao Khanorkar posted at 68th Court, Borivali, Mumbai.


The Law Says


In the matter of Central Board of Dawoodi Bohra Community and another Vs. State of Maharashtra and another, a Five-judge constitution bench of the SC held, “A decision delivered by a bench of larger strength is binding on any subsequent bench of lesser or coequal strength. A bench of lesser quorum cannot doubt the correctness of the view of the law taken by a bench of larger quorum. A view of the law taken by a bench of three judges is binding on a bench of two judges and in case the bench of two judges feels not inclined to follow the earlier Three-judge bench decision then it is not proper for it to express such disagreement; it can only request the Chief Justice for the matter being placed for hearing before a Three-judge bench which may agree or disagree with the view of the law taken earlier by the Three-judge bench."

Patel says “The ground reality is that Indian judiciary is corrupt.”
